Terms of Service & Usage Agreement

1. Acceptance of Terms
By creating an account, installing the Digent Smart AI WordPress plugin, or connecting to the Digent Cloud Gateway API, you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company, organization, or client, you represent that you have the legal authority to bind such entity.
2. Description of the Service
Digent Smart AI provides a cloud-based communication bridge implementing the Model Context Protocol (MCP) and REST endpoints to route authenticated, cryptographically signed commands between artificial intelligence applications (including Claude, Cursor IDE, ChatGPT) and your self-hosted WordPress websites.
3. Autonomous Mode & "Dangerously Bypass Approvals" Disclaimer
The Digent Smart AI WordPress plugin includes an optional feature designated as "Dangerously bypass approvals" (Autonomous Mode). By intentionally enabling this feature:
- You acknowledge that you are authorizing connected AI models to execute write, modify, delete, and plugin upgrade commands on your WordPress server without requiring interactive user approval.
- You agree that you are solely responsible for maintaining current, off-site backups of your WordPress database and filesystem before initiating automated agent workflows.
- Digent Smart AI and its affiliates shall not be liable for any data loss, database corruption, plugin incompatibility, theme disruption, or website downtime caused by autonomous AI actions executed under this bypass mode.
4. Acceptable Use Policy
You agree not to use the Digent Smart AI platform to:
- Deploy malware, spyware, phishing payloads, or malicious scripts to any WordPress installation.
- Bypass server access controls, execute unauthorized shell exploits, or attempt privilege escalation.
- Attempt to reverse-engineer, decompile, or tamper with the Digent SaaS cryptographic gateway service.
- Generate unauthorized high-frequency automated traffic intended to degrade server responsiveness (Denial of Service).
5. Subscription & Cancellation
Paid subscriptions (Pro and Agency) are billed in advance on a recurring monthly or annual basis. You may cancel your subscription at any time through your dashboard settings. Upon cancellation, your plan will remain active until the end of the current billing cycle, after which your account will revert to the Developer Free tier limits.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGENT SMART AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE GATEWAY SERVICE.
7. Modifications to Service and Terms
We reserve the right to modify or replace these terms at any time. When modifications are material, we will notify registered users via email or by displaying a prominent notice within the dashboard at least 14 days prior to new terms becoming effective.
